provisions which would operate if and when the Port Trust became established as a separate entity,
in connection with (b), Mr. Colman will, I understand, put up his establishment proposals on the basis of taking over existing staffs with possibly Commander Jolly and Mr. Nicol as heads of the Marine Department and Port Engineers Department respectively, after he has discussed the proposition with those two officers. It is, in my view, essential that the proposed establishment and the salaries and costs thereof should be available when the Ordinance is being considered. This is necessary, not only for the purpose of the consideration of the draft ordinance in the Legislative Council in the Colony, but also in order that we may seek Treasury agreement to the expenditure involved before the Ordinance is passed. It will probably be better, however, to defer approaching the Treasury until the draft Ordinance is formally aubmitted for consideration by the Governor in accordance with (4) above.
I take it that you will now arrange for the draft Ordinance to be revised and considered by the London Committee, which might also wish to have the establishment proposals if they are ready in time.

The Hong Kong Port Consultative Committee, as you know, met and considered the draft, Ordinance. It was agreed that in lieu of a formal report, the minutes of the meetings and the memoranda considered by the Committee would be submitted for the information of the Secretary of State.
